Dr. McCracken’s book is partly historical and partly analytical. It opens with as good a summary of Irish history from the founding of the Gaelic League in 1893 until the general election of 1918 as one could wish for. The resounding victory won by Sinn Féin in 1918 prepared the way for the first and second Dáil, whose membership is here analysed from the standpoints of age, religion, education and occupation with some interesting results. This paper discusses basic concepts and recentdevelopments in intellectual property ownership in theUnited States. Various philosophical arguments havepreviously been put forward to support the creation andmaintenance of intellectual property systems. However, in an age of information, access toinformation is a critical need and should beguaranteed for every citizen. Any right of controlover the information, adopted as an incentive toencourage creation and distribution of intellectualproperty, should be subservient to an overriding needto ensure access to the information. The principlesunderlying intellectual property regimes (...) in the UnitedStates recognize and embody this. In addition, thephilosophical/ethical dimensions of this debate couldalso be structured to support this attitude as well. Intellectual property is fast becoming digitalproperty. New technologies allow owners to extendtheir control of both legitimate uses and misuses ofthe intellectual property. Recent trends demonstratethat the access principle has not always beenparamount in judicial or legislative applications. Thetrend rather is to allow a proprietarianism factor todominate the analysis. Finally, several principles areforwarded which would assist adjudicators and policymakers in reaffirming the basic purpose of theintellectual property law, which is to benefit thepublic at large. This article explores recent developments inthe regulation of Internet speech, inparticular, injurious or defamatory speech andthe impact the attempts at regulation arehaving on the `body' in the sense of theindividual person who speaks through the mediumof the Internet and upon those harmed by thatspeech. The article proceeds in threesections. First, a brief history of the legalattempts to regulate defamatory Internet speechin the United States is presented; a shortcomparative discussion of defamation law in theUK and Australia is included. As discussedbelow, this (...) regulation has altered thetraditional legal paradigm of responsibilityand, as a result, creates potential problems forthe future of unrestricted and even anonymousspeech on the Internet. Second, an ethicalassessment is made of the defamatory speechenvironment in order to determine which actorshave moral responsibility for the harm causedby defamatory speech. This moral assessment iscompared to the developing and anticipatedlegal paradigm to identify possible conformityof moral and legal tenants or to recognize theconflict between morality and law in assigningresponsibility to defamatory actors. Thisassessment then concludes with possiblesuggestions for changes in the legal climategoverning the regulation of defamatory speechon the Internet, as well as prediction of theresult should the legal climate continue todevelop on its present course. This is not tosuggest that all law, or even the law ofdefamation, be structured to reflect thesubjectivity of a moral construct, but since itis the authors position that the legalassignment of liability in online settings ismisaligned, this reflection can serve asbeginning reassessment of that assignment. As the National Information Infra- structure develops new avenues for information products and services will open. Creating, identifying and protecting the information market space is a critical component to the success of information product and service developments. As a result, the producers of those products and service seek to protect their proprietary interest in the underlying information. However, these actions have broader consequences: Attempts to extend legal protection to basic facts and other public domain information demonstrate that the public information (...) space is slowly being reduced. Reviewing several information controversies as case studies is fruitful. Not only for assessing current trends in information disputes (warfare) but can form the basis for establishing several predictors useful in determining when future information ownership controversies may develop and result in the loss of public information space. One set of predictors helps define the information controversy and is descriptive. The second set of predictors characterizes the marketplace environment. It provides further nuance to the economic factors that force information owners to seek legal remedy. Identifying instances where both models suggest a change in information rights or ownership is most likely to result in the critical loss of access to public information space. (shrink)

We present a theoretical view of the cellular foundations for network-level processes involved in producing our conscious experience. Inputs to apical synapses in layer 1 of a large subset of neocortical cells are summed at an integration zone near the top of their apical trunk. These inputs come from diverse sources and provide a context within which the transmission of information abstracted from sensory input to their basal and perisomatic synapses can be amplified when relevant. We argue that apical amplification (...) enables conscious perceptual experience and makes it more flexible, and thus more adaptive, by being sensitive to context. Apical amplification provides a possible mechanism for recurrent processing theory that avoids strong loops. It makes the broadcasting hypothesized by global neuronal workspace theories feasible while preserving the distinct contributions of the individual cells receiving the broadcast. It also provides mechanisms that contribute to the holistic aspects of integrated information theory. As apical amplification is highly dependent on cholinergic, aminergic, and other neuromodulators, it relates the specific contents of conscious experience to global mental states and to fluctuations in arousal when awake. We conclude that apical dendrites provide a cellular mechanism for the context-sensitive selective amplification that is a cardinal prerequisite of conscious perception. (shrink)

An experimental, conceptually driven foray into the Patrician field, Ireland’s ubiquitous national apostle – a former captive – is utilised as a vehicle through which to explore a trinity of salient and interrelated themes within the Catholic and Protestant hinterlands of the Irish imagination: visions of imprisonment; of the island; and of imperialism. The reader is guided through aspects of Patrician literature, visits the island’s hallowed Patrician shrines, and is thus shown Purgatory. Insights into the imaginations exhibited by a range (...) of influential Irish ideologues and intellectuals – Gerry Adams; J.B. Bury; John Hume; Eóin MacNeill; Michael McCarthy; John Mitchel; Peadar O’Donnell; Tomás Ó Fiaich; John Ryan; William Ryan; Ian Paisley; Patrick Pearse; Oscar Wilde – are generated. The cognitive (and conspicuously Platonic) terraforming of the prison-cell into an island, and of the island into a giant prison – of either British or Vatican construction – that recurs in much Irish political thought and reflection, is observed. The concluding section involves historiographical reflection: Bury’s, and by extension St. Patrick’s, influence with regards the development of the discipline of Irish history is highlighted. That the island exhibits a distinctive intellectual micro-climate, one in which visions of Patrick act as a formidable ideological force, is implicit throughout. (shrink)

Critical congenital heart disease screening is rapidly becoming the standard of care in the United States after being added to the Recommended Uniform Screening Panel in 2011. Newborn screens typically do not require affirmative parental consent. In fact, most states allow parents to exempt their baby from receiving the required screen on the basis of religious or personally held beliefs. There are many ethical considerations implicated with allowing parents to exempt their child from newborn screening for CCHD. Considerations include the (...) treatment of religious exemptions in our current legal system, as well as medical and ethical principles in relation to the rights of infants. Although there are significant benefits to screening newborns for CCHD, when a parent refuses for religious or personal beliefs, in the case of CCHD screening, the parental decision should stand. Nursing is possible owing to a series of intricate systemic relations. Building on an established tradition of sociological research, we critically analysed the nursing profession in Chile, with an emphasis on its education system, in the light of social systems theory. The paper's aim was to explore basic characteristics of nursing education as a system, so as to outline its current evolution. Drawing on recent developments in nursing, we applied an empirical framework to identify and discuss functionally differentiated systems that (...) are relevant to nursing and observe communications between them. We found that the dynamics of nursing as a whole develop from communications with closely related systems, including the nursing profession and the education system more broadly. While the discipline (as a system of representations) strives to control the profession (as an applied occupational field), the necessities of practicing nurses imply other forces mediating the making of the profession, a process framed by market dynamics in education and health. In early April 1911 Albert Einstein arrived in Prague to become full professor of theoretical physics at the German part of Charles University. It was there, for the first time, that he concentrated primarily on the problem of gravitation. Before he left Prague in July 1912 he had submitted the paper "Relativität und Gravitation: Erwiderung auf eine Bemerkung von M. Abraham" in which he remarkably anticipated what a future theory of gravity should look like. At the occasion of the Einstein-in-Prague (...) centenary an international meeting was organized under a title inspired by Einstein's last paper from the Prague period: "Relativity and Gravitation, 100 Years after Einstein in Prague". The main topics of the conference included: classical relativity, numerical relativity, relativistic astrophysics and cosmology, quantum gravity, experimental aspects of gravitation, and conceptual and historical issues. The conference attracted over 200 scientists from 31 countries, among them a number of leading experts in the field of general relativity and its applications. This volume includes abstracts of the plenary talks and full texts of contributed talks and articles based on the posters presented at the conference. These describe primarily original results of the authors. Full texts of the plenary talks are included in the volume "General Relativity, Cosmology and Astrophysics--Perspectives 100 Years after Einstein in Prague", editions. J. Bičák and T. The Continuous Parameter Estimation Model is applied to develop individual genomic-level heritabilities for the latent hierarchical structure and developmental dynamics of Life History (LH) strategy LH strategies relate to the allocations of bioenergetic resources into different domains of fitness. LH has moderate to high population-level heritability in humans, both at the level of the high-order Super-K Factor and the lower-order factors, the K-Factor, Covitality Factor, and General Factor of Personality (GFP). Several important questions remain unexplored. We developed measures of genome-level (...) heritabilities employing an American sample of 316 monozygotic (MZ) and 274 dizygotic (DZ) twin dyads and a Swedish sample of 863 MZ and 475 DZ twin dyads. This novel heritability index measures individual genetic transmissibility, therefore opening new avenues for analyzing complex interactions among heritable traits inaccessible to standard structural equations methods. For these samples: (1) moderate to high heritability of factor loadings of Super-K on its lower-order factors is demonstrated, evidencing biological preparedness, genetic accommodation, and the gene-culture coevolution of biased epigenetic rules of development; (2) moderate to high heritability of the magnitudes of the effect of the higher-order factors upon their loadings on their constituent factors, evidencing genetic constraints upon phenotypic plasticity; and (3) that heritability of the LH factors, of factor loadings, and of the magnitudes of the correlations among factors are weaker among those with slower LH speeds, demonstrating that inter-individual variation in transmissibility is a function of individual socioecological selection pressures. En el presente documento se abordan algunas de las contribuciones más recientes al debate filosófico en implicancia con las modificaciones de la clínica psicoanalítica actual. Nuestro objetivo fue mediante un análisis documental con miramiento teóricocrítico contribuir al esclarecimiento de las herramientas fundamentales que la filosofía entrega a la modificación de la teoría y práctica psicoanalítica. (...) Para tal efecto, hemos trazado un recorrido histórico general a las modificaciones y argumentos que a lo largo de la historia del psicoanálisis hanido emergiendo. This article presents Gilbert Simondon as a philosopher of (technological) mediation. An attempt is made to combine and present Simondon’s multifaceted and often sporadic perspectives on the subject of (technological) mediation. At the same time, it is attempted to contextualize Simondon’s thought in light of other authors and philosophical theories to show its relevance and similarities. First of all, the relevance of Simondonian ontogenetic account of mediation to contemporary philosophy of mediation is shown. Secondly, Simondonian critique of the conceptual structure (...) of hylomorphism, understood through the lens of mediation, is compared with the Heideggerian one. Both interpretations are understood through Verbeek’s suggestion to ruminate on how technologies mediate our grasp of metaphysics. Lastly, political and scientific aspects of the Simondonian concept of mediation are discussed. In between, Simondon’s general ambivalent position on the progress of technology is shown. (shrink)

El artículo aborda la Teoría de la Constitución de Carl Schmitt, atendiendo a su doble acepción de teoría general de la constitución moderna y cuerpo de doctrina acerca de la constitución de Weimar. El primer apartado presenta la sistemática de la teoría positiva de la constitución moderna, reponiendo sus dos elementos estructurantes: la forma política resultante de la aplicación de los principios político-formales de identidad y representación, y las formas de legislación y gobierno propias del Estado de derecho burgués. La (...) segunda parte se centra en el cuerpo de doctrina acerca de la constitución de Weimar que Schmitt desarrolla apelando a las categorías presentadas en la primera parte. En especial, se analizan sus implicancias para comprender la posición de Schmitt respecto a los principales desafíos doctrinarios de la época, contrastando sus posiciones con las de otros grandes juristas contemporáneos. Finalmente, se recapitulan las conexiones de sentido entre los criterios que informan la teoría general de la constitución moderna y la doctrina de la constitución de Weimar, destacando las peculiaridades del esfuerzo de Schmitt por subrayar la integridad de la constitución frente a los diversos modos de relativización que atribuye tanto al positivismo jurídico como a ciertas posiciones políticas de su época. Some philosophers believe that when epistemic peers disagree, each has an obligation to accord the other's assessment the same weight as her own. I first make the antecedent of this Equal-Weight View more precise, and then I motivate the View by describing cases in which it gives the intuitively correct verdict. Next I introduce some apparent counterexamples – cases of apparent peer disagreement in which, intuitively, one should not give equal weight to the other party's assessment. To defuse these apparent (...) counterexamples, an advocate of the View might try to explain how they are not genuine cases of peer disagreement. I examine David Christensen's and Adam Elga's explanations and find them wanting. I then offer a novel explanation, which turns on a distinction between knowledge from reports and knowledge from direct acquaintance. Finally, I extend my explanation to provide a handy and satisfying response to the charge of self-defeat. (shrink)

This article explores the philosophy of Alain Badiou from the vantage point of the concepts of the localization, delocalization, and relocalization of the void as thematized through literary arts, religion, emancipatory politics, and the subject of psychoanalysis. In short, these moments around the void characterize the processes through which truth is processed and seen through their full realization by a philosophical engagement across the various conditions in which these truths occur. The localization of a void is the naming of an (...) indiscernible element that is incommensurable to the rubric of constructible knowledge, sense and meaning which could saturate the space of truth. Thus, the naming that localizes the void acts as a subtraction of the invariant in the variance of situation such that across various points in space and time, we are still able to subtract the universal as the invariant not just as the fidelity to the localized truth but also as the resurrection of truth upon its relocalization at a different place and a different time. At its core, this article is concerned with truth, why truth is persistent, and why we have to struggle to articulate the truth that we are trying to be faithful to again and again with each instance that truth risks being covered-over and obscured. Pro lidské jednání je důležitý vztah volního a nevolního momentu, svobody a danosti. Ve své práci bych se chtěl zabývat vztahem volního a nevolního momentu v trilogii P. Ricoeura Filosofie vůle (především v jejím prvním dílu). Ricoeur ukazuje odkázanost a propojenost obou momentů ve třech fázích jednání, jimiž je rozhodování, čin a souhlas. Pokud nevolní moment převládne nad volním, propadá člověk zlu. Cílem člověka by mělo být dobro: ovládnutí nevolního momentu vůlí a vztah k druhému člověku. Problematičnost rozdělení světa na (...) dobro a zlo ukazují úvahy F. Nietzscheho v interpretaci P. Kouby. Pro Nietzscheho jsou dobro a zlo nejednoznačné a provázané. Jeho pohled interpretovaný P. Koubou nám ukazuje člověka zcela odkázaného na sebe sama, bez opory v jasném rozdělení světa. Pokusím se důkladněji vyložit Ricoeurův popis volního a nevolního momentu a ukázat, zda a nakolik na něj lze uplatnit Nietzscheho kritiku. Závěrem přiblížím alternativu vůči morálce na jedné straně a relativismu na druhé, kterou ve své interpretaci Nietzscheho nabízí P. Kouba. (shrink)

The multitude of training models and curricula for the specialty of clinical neuropsychology around the world has led to organized activities to develop a framework of core competencies to ensure sufficient expertise among entry-level professionals in the field. The Standing Committee on Clinical Neuropsychology of the European Federation of Psychologists’ Associations is currently working toward developing a specialty certification in clinical neuropsychology to establish a cross-national standard against which to measure levels of equivalency and uniformity in competence and service provision (...) among professionals in the field. Through structured interviews with experts from 28 European countries, we explored potential areas of core competency. Specifically, questions pertained to the perceived importance of a series of foundational, functional, and other competencies, as well as current training standards and practices, and optimal standards. Our findings revealed considerable agreement on academic and clinical training, despite varied actual training requirements currently, with fewer respondents relegating importance to training in teaching, supervision, and research, and even fewer to skills related to management, administration, and advocacy. European expert clinical neuropsychologists were in agreement with previous studies regarding the importance of sound theoretical and clinical training but management, administrative, and advocacy skills were not central to their perspective of a competent specialist in clinical neuropsychology. Establishing a specialty certificate in clinical neuropsychology based on core competencies may enable mobility of clinical neuropsychologists across Europe, and, perhaps, provide an impetus for countries with limited criteria to reconsider their training requirements and harmonize their standards with others. Prostřednictvím Hegelovy filosofie ducha předkládaná studie usiluje ospravedlnit Descartovo „umrtvení“ přírody na res extensa jakožto výlučnou podmínku možnosti řešení environmentální krize. Odhaluje, že moderní vykořisťující vztah člověka k přírodě není základem environmentální krize, nýbrž základem jejího řešení. Toto odhalení odvrací naši pozornost od (teoretického) soustředění se na základ a nutí vyjít vstříc (praktickému) každodennímu životu. Toto „překonání zprostředkování“ ústí ve stanovisko „reflektované naivity“, které ví, že nemá „přehodnocovat“ kapitalismem institucionalizovaný instrumentální vztah člověka k přírodě, nýbrž ho konsekventně naplňovat, aby lidstvo (...) vymáhalo energii z přírody ještě efektivnějším způsobem a tím vytlačilo z trhu způsob méně účinný. Příslibem je, že ještě efektivnější vymáhání energie z přírody dovolí ponechat přírodu zasaženou méně účinným vymáháním nedotčenou ve smyslu Heideggerova konceptu Gelassenheit. (shrink)

We motivate the possibility of using notions and methods derived from quantum physics, and more specifically from the research field known as ‘quantum cognition’, to optimally model different situations in the field of medicine, its decision-making processes and ensuing practices, particularly in relation to chronic and rare diseases. This also as a way to devise alternative approaches to the generally adopted double-blind gold standard.

Článek se pokouší o koherentní interpretaci Quinových nečetných vyjádření na téma realismus. Autor konstatuje, že Quinovy názory vykazují různorodé tendence: Quine ve svých textech přechází od úvah, které bychom označili za idealistické , k pozici spíš realistické. Článek má dvě části. První je věnována Quinovu chápání positů a jeho tezím o naturalizaci filosofie a imanenci pravdy teorii. Druhá část pak obsahuje úvahu o Quinově známé tezi o nevymezitelnosti reference a jejích důsledcích pro otázku realismu. Autor dochází k závěru, že diskrepance (...) epistemologického a ontologického hlediska, přítomná v mnoha Quinových pracích, vede k permenantnímu rozštěpu dvou hledisek na realitu vnějšího světa, která se zdají být neslučitelná v jedné koherentní filosofické pozici. The Florilegium Coislinianum, a largely unpublished Byzantine spiritual anthology, provides a fuller perspective on an intriguing exegetical work attributed to Athanasius of Alexandria, the Fragmenta in Matthaeum. The authenticity of the work has been contested. However, while it is certain that it was not written in toto by Athanasius, the possibility remains that it contains traces of now-lost texts of the Alexandrian theologian.

Humanitarian operations may pose challenges to which armed forces prepared for warfighting seem rather ill-equipped. It is the aim of this article to examine in what way military ethics should be adapted to humanitarian tasks. Two ideal types of military ethics are defined here: warfighting and humanitarian. The warfighting ethic is supposed to maximise the utility of the military in war and combat and to that end utilises the virtues of loyalty and honour. In contrast, humanitarian obligations require to a (...) larger extent the development of personal integrity and an ability to follow one’s own conscience. The adaptation of military ethics is demonstrated in the case studies of the UK armed forces and the German Bundeswehr. Whereas the moral code of the UK armed forces remains anchored in the principles of the warfighting ethic, the case of the Bundeswehr presents a military ethic closely approximating the humanitarian ideal type. CATEGORICAL, DISPOSITIONAL PROPERTIES AND LAWS OF NATURE Pohľady na empirickú nevyhnutnosť možno rozdeliť do dvoch skupín: teórie slabej nevyhnutnosti a teórie silnej nevyhnutnosti. Do prvej teórie patria koncepcie, ktoré uvažujú svet zložený z pasívnych vlastností, akými sú kategorické vlastnosti. Za zmeny vo svete sú zodpovedné zákony prírody, ktoré sa od možného sveta k svetu líšia, a preto aj prejavy týchto vlastností sú odlišné. Druhú teóriu, teóriu silnej nevyhnutnosti, zastávajú filozofi, ktorí predpokladajú existenciu silovo aktívnych (...) vlastností, dispozícií. Práve tieto sú zodpovedné za zmeny vo svete, a vo všetkých možných svetoch sa prejavujú nevyhnutne rovnako. Autor argumentuje v prospech existencie dispozičných vlastností a tvrdí, že dispozičný výklad sveta netrpí modálnymi absurdnosťami, ktorými trpia teórie slabej nevyhnutnosti. Hoci aj dispozičné teórie majú svoje problémy a hlavne mysterióznosti, ktoré môžu viesť až do metafyziky dispozičných monád. Kľúčové slová: dispozičné vlastnosti, kategorické vlastnosti, modality, nevyhnutnosť, zákony prírody. (shrink)

Networked service organisations are increasingly adopting a ‘smarter networking’ philosophy in their design of more agile and customer-focused supply models. Changing consumer behaviours and the emergence of transformative technologies—industry 4.0, artificial intelligence, big data analytics, the Internet of Things—are driving a series of innovations, in terms of ‘products’ and business models, with major implications for the industrial enterprise, in their design of more ‘digitalised’ supply chains. For B2B systems, emerging ‘product-service’ offerings are requiring greater visibility, alignment and integration across an (...) increasingly complex network of multiple partners and collaborators, in order to deliver a better service and customer ‘experience’. To support the design and operation of these multi-organisational service networks, we outline a concept of operations architecture here, underpinned by the literature and network theory, and demonstrate application using a series of exemplar case studies. Focusing on relational elements and the processes key to network integration within service supply networks, the cases inform a set of operating principles and protocols—applicable to all stakeholders ‘cooperating’, within a ‘shared’ environment. Equally critical is to understand how digital technologies may influence future operating philosophies. This article extends our theoretical understanding of network organisations, from a traditional ‘product’ perspective to that of ‘services’, and presents the case for developing a common, unified approach to designing diverse forms of multi-partner service networks.
